WEEKEYE — TERMS OF SERVICE

Welcome to WeekEye, operated by WeekEye ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the WeekEye platform, including mobile applications, web applications, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
WeekEye is a business-oriented workforce management platform designed to support organizations with scheduling, personnel management, assignment tracking, operational planning, communication, and related organizational processes. The Service is primarily provided to organizations ("Organizations") and their authorized users ("Users").
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an Organization, you represent that you have the authority to bind that Organization to these Terms.
3. Account Registration
To access certain features, you must create an account. You may register using:
- Email address and password
- Google Sign-In
- Sign in with Apple
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at support@weekeye.com.
4. Organizational Use
If you access WeekEye through an Organization account:
- Your use is subject to the Organization's policies and these Terms
- The Organization may manage, restrict, or terminate your access at any time
- The Organization may access, monitor, and export data you create within the platform
- Your personal data may be visible to Organization administrators
In this context, the Organization acts as the data controller and WeekEye acts as a data processor.
5. Business Model and Paid Services
WeekEye services are provided to Organizations through:
- Direct business agreements and enterprise contracts
- Web-based subscription plans purchased outside the mobile application
- Invoicing and organizational procurement processes
The mobile application does not sell consumer digital content or individual subscriptions directly within the app. Access is determined by the Organization's existing business subscription or agreement with WeekEye. Individual users receive access as determined by their Organization's plan.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Access data outside your authorized scope
- Attempt to bypass, disable, or circumvent security controls
- Upload or transmit malicious code, viruses, or harmful content
- Share your login credentials with unauthorized persons
- Use the Service for unauthorized commercial purposes
- Collect or harvest user data without authorization
- Interfere with or disrupt the integrity or performance of the Service
- Attempt unauthorized access to any account, system, or network
- Use automated tools, bots, or scrapers without written permission
7. Intellectual Property
The Service and its original content, features, and functionality are owned by WeekEye and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
You retain ownership of data you input into the Service. By using the Service, you grant WeekEye a limited license to process your data solely to provide the Service.
8. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
9. Account Deletion
You may delete your account at any time through the application settings (Settings → Account → Delete Account). Upon deletion:
- Your access to the Service will be immediately revoked
- Your personal information will be anonymized or deleted
- Some data may be retained where required by law or for legitimate security purposes
- Organization data you created may remain accessible to Organization administrators subject to their data retention policies
10. Third-Party Services and Integrations
The Service may integrate with or contain links to third-party services including Google, Apple, and other providers. These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.
When you use third-party sign-in (Google or Apple), those providers' terms and privacy policies apply to the authentication process.
11. Security
We implement industry-standard security measures including encryption in transit and at rest, multi-factor authentication options, role-based access controls, and security monitoring. However, no system is completely secure. You acknowledge that you use the Service at your own risk and agree to maintain the security of your account credentials.
Biometric authentication features (where available) store biometric identifiers locally on your device. We do not store raw biometric data on our servers.
12. Availability and Service Changes
We do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue the Service (or any part thereof) with or without notice. We reserve the right to update the Service, add or remove features, and change pricing (with appropriate notice to Organizations).
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEEKEYE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
15. Indemnification
You agree to indemnify, defend, and hold harmless WeekEye and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your content or data submitted to the Service.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 13, 14, 15, 17, and 18 of these Terms survive termination.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law. For Organizations and users in the European Union, consumer protection laws of the EU member state where you reside apply. For Organizations and users in California, California law applies. For all other users, the laws of the jurisdiction in which WeekEye primarily operates apply.
Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes may be submitted to binding arbitration or the competent courts in the applicable jurisdiction.
18. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms with a new effective date and, where appropriate, by email or in-app notification. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
